Part A: NACHT WACHT and these terms
1. Who we are
- NACHT WACHT is a brand of Hagen Festivals B.V., Utrechtseweg 310 B46, 6812 AR Arnhem, the Netherlands. Chamber of Commerce (KVK): 09161724. VAT: NL815973378B01. In these terms, "we", "us" and "NACHT WACHT" refer to Hagen Festivals B.V.
- Questions? Email us at info@nacht-wacht.nl.
2. When these terms apply
- These terms apply to every ticket for a NACHT WACHT event, to every visit to one of our events and to everything you buy from us through nacht-wacht.nl or our ticket shop. "You" means the ticket holder or visitor.
- They apply no matter how you got your ticket: bought from us, bought through official resale, or received from someone else. Whoever passes a ticket on must make sure the new holder knows these terms apply.
- These terms are meant for consumers. Business customers (for example for group or corporate bookings) get separate agreements.
- We may update these terms. The version published on this page at the time of your purchase applies to that purchase. If we make a change that significantly affects you, we will let you know by email or on our website.
- These terms are also available in Dutch. If the two versions differ, the Dutch version prevails.
Part B: Tickets
3. Buying tickets
- Our primary ticket sales run through our ticket shop, powered by Weeztix. Payment and delivery of your ticket are handled by them, and the Weeztix terms for ticket buyers apply to that part of the process.
- All prices include VAT. Any service or transaction fees are shown before you pay.
- We can set a maximum number of tickets per order or per person. Orders that exceed this limit, or that we reasonably suspect are bought for commercial resale, can be cancelled.
- Tickets are for leisure on a specific date, so you have no 14-day cooling-off period (the exception in Dutch Civil Code article 6:230p, under e). Once bought, a ticket cannot be returned or exchanged, except as described in these terms.
4. Your ticket
- Your ticket is a personal barcode that gives one person access to one event (or one event day). The first scan of a barcode gets in; any copy scanned afterwards will be refused. We do not have to check who the rightful owner of a ticket is.
- Keep your barcode to yourself. Do not post it online or share screenshots. You are responsible for loss, theft or misuse of your ticket once it has been delivered to you.
- There is no re-entry. Once you leave the venue, your ticket is no longer valid.
- A ticket that does not scan, has been tampered with or is most likely fake is not valid. Whoever holds it stays outside and gets no refund or compensation.
- Your ticket only gives access to the areas it was sold for. Areas such as VIP, backstage or crew zones are off-limits without the matching ticket or wristband.
- Our events are strictly 18+. Bring a valid, original ID (passport, ID card or driving licence). No valid ID or under 18 means no entry and no refund.
5. Cancellation and postponement
- Sometimes an event cannot go ahead as planned because of circumstances beyond our control. Think of government measures, losing a permit, severe weather (storms, thunderstorms, extreme rain or snow), fire, safety or terror threats, strikes, transport disruptions, suppliers or the venue not delivering, or a headliner falling ill. In that case we may reschedule the event, switch to a different venue, shorten it, close part of it, or cancel it.
- If only part of an event cannot go ahead, for example one stage closing or the event ending early for safety reasons, there is no (partial) refund.
- If an event is postponed, your ticket stays valid for the new date. If you cannot make it, you can request a refund within the period and in the way we announce at the time.
- If an event is cancelled entirely, we refund the face value of tickets bought through our official ticket shop. Service fees and costs such as travel and accommodation are not refunded, unless the law requires otherwise. Tickets resold through TicketSwap are refunded as described in the resale part below.
- We will announce how refunds work through our website and by email to the original buyer.
Part C: Resale
6. Reselling and passing on tickets
- Commercial resale of our tickets is not allowed. That includes selling for profit, selling in bulk and offering tickets through ticket platforms, social media or marketplaces that we have not approved.
- Without our written permission, tickets may also not be used for any other commercial purpose: as a prize in a giveaway or contest, in promotions or advertising, or as part of a package deal (for example with bus travel, a hotel or a trip).
- The only official resale channel for our events is TicketSwap, under the conditions in the next section. Tickets resold through any other channel may be blocked without warning. A blocked ticket gives no right to entry, a refund or any compensation, also not for the person who bought it in good faith.
- You may give your ticket to a friend or family member for free or at no more than what you paid. You remain responsible for that ticket, and the person you give it to has to follow these terms and our house rules.
- We may block tickets and refuse entry to their holders if we find that these rules have been broken. Blocked tickets are not refunded, including any service fees paid.
- Bought a ticket anywhere other than our ticket shop or TicketSwap? That is at your own risk. We are not liable for the validity of such a ticket or for any loss that comes from it.
7. Official resale through TicketSwap
- As an exception to the previous section, you may resell your ticket through TicketSwap for events where we have enabled resale. You can reach it through the "Sell on TicketSwap" link on your ticket page or in your order confirmation, or through the event page on TicketSwap. Buyers can find available tickets there as well.
- We decide per event whether resale is available and under what conditions: from when it opens, the minimum and maximum resale price, the fees and whether Shared Resale applies. Conditions can differ from event to event and are always shown on TicketSwap before you list or buy a ticket. We may adjust them; the conditions shown at the moment you list or buy apply to that listing or purchase. The resale conditions of an event form part of these terms. Once resale has been switched on for an event and the first ticket has been listed, it stays available for that event.
- We make the resale marketplace for our events available; TicketSwap B.V. provides the technology, payment handling, fraud prevention and customer service. The sale itself is an agreement directly between the seller and the buyer. When a resale is completed, the seller's barcode is cancelled and the buyer receives a new ticket with a new barcode.
- The seller chooses the price, within the minimum and maximum we have set for that event. These limits are a percentage of the face value of the ticket and stay within the limits that TicketSwap and the law allow.
- Resale comes with the following fees from us. The Buyer Service Fee and Seller Service Fee together are our Event Partner Fees; the Shared Resale Compensation comes on top where it applies:
- Buyer Service Fee: charged to the buyer on top of the resale price.
- Seller Service Fee: deducted from the amount the seller receives.
- Shared Resale Compensation (only for events where Shared Resale applies): a share of the amount by which the resale price is higher than the face value, owed by the seller and deducted from the payout.
- In addition, TicketSwap charges the buyer its own Transaction Fee for handling the transaction safely. That fee belongs to TicketSwap and is not a NACHT WACHT fee.
- Your use of TicketSwap (your account, payments, payouts, buyer protection and support) is covered by a separate agreement between you and TicketSwap, under the TicketSwap terms and conditions. For questions about a specific resale transaction, contact TicketSwap support.
- If an event is cancelled, the refund for a ticket that was resold through TicketSwap is paid to TicketSwap, after deduction of administration costs, and TicketSwap passes the amount it received on to the buyer who last bought that ticket. The original seller is not entitled to a (second) refund.
- In case of fraud, abuse or a breach of these terms or the resale conditions, we and TicketSwap may remove listings, cancel resales and block the tickets involved.
Part D: Your visit
8. At the event
- Our house rules are part of these terms. In short: 18+ with valid ID, zero tolerance on drugs (including nitrous oxide), no glass, cans, weapons, fireworks, food or drinks brought in, and no aggression, discrimination or (sexual) harassment. Always follow the instructions of our staff, security, the venue and emergency services.
- Security may search you and your belongings at the entrance and during the event. If you refuse, you will not be let in. Prohibited items can be confiscated and will not be returned or may be destroyed; illegal items are handed over to the police.
- We may refuse entry to anyone, or remove them from the event, when this is needed for the safety or comfort of others, or when someone breaks these terms or our house rules. This includes visitors who are clearly drunk or under the influence, and visitors wearing clothing, texts or symbols that are offensive, discriminating or likely to cause trouble. In those cases there is no refund and no compensation.
- Not allowed without our written permission: selling or handing out goods, flyers or promotional material at or around the event. Never allowed: climbing on stages, barriers, rigging, roofs or other structures, or putting yourself or others in danger.
- Throw your waste in the bins. Cups, glasses and other property of ours or the venue stay inside.
- If we or the venue get fined because of something you did, such as smoking indoors, we will pass that fine on to you.
- The venue may have its own rules on top of ours. Where they apply, you must follow those as well.
- Tokens and other drink credits are only valid at the event where you bought them and cannot be exchanged for money.
- Extras bought in advance, such as token, locker or parking vouchers, work like your ticket: keep them safe, because lost or stolen vouchers are not replaced. Lockers are used at your own risk.
9. Line-up and programme
- We do everything we can to run the event as announced, but line-ups, set times and stage plans can change. A change in the programme or an artist cancelling does not entitle you to a refund.
10. Photos, video and recordings
- We and our partners take photos and make video and audio recordings at our events, including of the crowd. By attending, you accept that you may appear in these and that we may use them to promote NACHT WACHT. Do you not want a specific photo of you to be used? Email us and we will look into removing it.
- For safety reasons there may be CCTV at the venue. Footage can be shared with the police or other authorities when they are entitled to it.
- For your own memories, filming on your phone is fine. Professional cameras, recording gear or drones are not allowed without our written permission, and you may not use recordings of our events commercially.
11. Your safety and our liability
- You visit our events at your own risk. Music at our events is loud: wear earplugs and give your ears a break now and then.
- We are not liable for loss, theft or damage of your belongings, including in lockers or cloakrooms, unless caused by our own fault.
- Where we are liable, our liability is limited to direct damage and to no more than the amount paid out by our liability insurance in that case. If the insurer pays nothing, our liability is limited to the price of your ticket. We are never liable for indirect damage such as lost profit or missed travel.
- These limits do not apply if the damage was caused by our intent or gross negligence.
- Report any damage to us by email as soon as possible, and at the latest within 14 days after the event.
- You are liable for damage you cause to the venue, our property, other visitors or staff.
Part E: Other provisions
12. Third parties
- Parties such as Weeztix, TicketSwap, the venue, bar operators, food vendors and transport providers work with us, but are responsible for their own products and services. Where they have their own terms, those apply to what you buy from them.
13. Our website
- We put a lot of care into the information on nacht-wacht.nl, but mistakes can happen. Times, line-ups and other details on the website are subject to change, and we cannot guarantee that the website is always available or free of errors.
- Links to other websites are there for your convenience. We are not responsible for the content of those websites.
14. Intellectual property
- The NACHT WACHT name, logo, artwork, photos, videos and other content on our website, socials and at our events belong to us or our licensors. You may not use them commercially without our written permission.
15. Privacy
- We use your personal data only to handle your ticket and visit, to keep our events safe and, if you signed up for it, to send you news. We do this as the GDPR requires. Contact us for any questions about your data.
16. Complaints and disputes
- Something not right? Email info@nacht-wacht.nl within two months after the event. We aim to reply within 14 days and will try to find a solution together.
- Dutch law applies to these terms. Any dispute that we cannot solve together will be handled by the competent court in Gelderland (Arnhem), unless mandatory consumer law gives you the right to go to another court.
- If any part of these terms turns out to be invalid, the rest stays in force. The invalid part is replaced by a valid rule that comes as close as possible to what was intended.
